Hello,
This question has two parts. The background is that a brand I am soon launching will feature a 'tune of the week'. The brand is related to high performance and high energy so every Monday on social media I will do a short video for that weeks tune of the week. On the brands website there will also be a page allowing people to access previous tunes of the week either at their respective sources (Youtube, Spotify, Soundclound etc), or on the page.
Part 1)
Is it legal for the brand to release a video on social media featuring a popular track every week?
Part 2.a)
Is it legal for the brand to keep a record of historic tracks on a web page using embedded links so the track is playable on the brands website?
Part 2.b)
Is it legal for the brand to keep a record of historic tracks on a web page using a URL so that the user clicks to navigate to the tracks source e.g. YouTube, Soundcloud?
I do not expect there to be promotion of products within said videos (Part 1), and no promotion of products on historic track page (Part 2) however the brand is not a charity and ultimately the videos are intended to create profit for the brand in some form whether that be increased customer base, increased customer loyalty etc. There will also be products for sale on the same website but not the same page.
